Children in entertainment law link

Post by tikto »

Hi,
Does anyone have a link to the actual law about work times allowed for children who perform? We are losing on a job as the council won't issue us a licence for after 4.30, they say the shoot would have to be outside by law for them to issue us licence but when I look on other councils info sites it says it is up to the council.
This is very disappointing and I would like to know if it is our council who is wrong or if it the actual law. Thanks.

What is the job and what is it for? The reason I ask is that my DD shot a Halifax TV commercial in February where the shoot was from 5pm to 10pm and we had no problem getting a licence, although the lady at our council is an absolute sweetheart and does everything possible to help the kids once they have been offered a job.

This is for morrisons and the reason they want Saturday til 10 and Sunday 5-7 is because they need the supermarket to be closed to public. You are fortunate, which councils are you? I want to move to your area!

We did a promo back in Dec and had a bit of a query from the LEA (Sutton) but it was quickly ironed out and the license was issued. We filmed outside !

Tikto, there are permitted hours set out by law that children can work and I think the latest for a 5-9 year old is 4.30 so assume your dd/ds comes in this age group. My dd is 12 and 9 and over can work until 7. My council advised me that it is not legal to issue a license to work outside those hours unless a special night license has been granted and that can be only given in certain circumstances. My dd had a night license to film until 9 one evening because there was a scene filmed at night in London when it had to be dark so impossible to do earlier at the time of year it was filmed. However, they said they would only give a night license if something could not be filmed within the permitted times so in the situation you describe my council (which is Surrey would have refused it as well.

It must be very disappointing for you and you would think that the production company would know the law.

I think you need this

http://www.legislation.gov.uk/uksi/1968 ... on/27/made

It's complicated, but if you work your way through it you'll see what children are and aren't permitted to do at different ages, with the exceptions set out too.

Next question...is this the latest version of the regs or has it been superseded? Does anyone know?

Hope this helps

Thanks everyone for your replies, our council is by the book and won't issue the licence even though the production company explained that they need to use a supermarket to film when it's closed. The law does say only if the shoot is outside should we be granted a licence so even if we were to appeal, we wouldn't get anywhere. It's just that some councils are more lenient than others, guess it wasn't meant to be for us and nothing we can do about it, bl**dy bureaucracy!

I really feel for you .Its so unfair when your child goes through the whole process of a casting and recall .You would think getting the license would be the easy part but no!!!!
Its about time the laws in this country were changed .Most of us on here would agree we are all for having rules to govern our childrens wellbeing ,but in most cases with LEA's its all about how nice the person is that you have in your area and that is JUST WRONG!!!!!!! All rules should apply accross the country and it should be a staright forward process !!!!!

I really hope your DC gets another job soon and all goes well for them they deserve abit of a break !!!! :(
